Binghamton Police Chief Joseph Zikuski has been placed on administrative leave following an altercation involving his girlfriend that occurred Friday in Johnson City, according to a statement from Binghamton Mayor Jared Kraham.
Assistant Chief John C. Ryan will serve as Acting Police Chief.
The incident, which was captured in a video and posted to social media by the homeowner Kristina Montgomery, is currently under investigation by the Johnson City Police Department.
Johnson City police told Fox 40 News they won't have any information about the investigation until Monday.
Montgomery posted details of the incident on Facebook, alleging that Zikuski’s girlfriend Susan Rice, Montgomery’s next door neighbor, “decided it was OK to harass my son and his friend, because they were sitting on the porch laughing and apparently she thought they was laughing at her!”
The 1 minute video begins with Zikuski's girlfriend standing in front of Montgomery’s house. Montgomery says she reported the incident to police and three Johnson City police officers responded at about 9:30 pm that evening. At that time, Montgomery tells Fox 40 she didn't know the man with Rice was the Binghamton police chief. She says she was outraged when officers failed to take action, even after viewing the video.
In the now-viral video, two male voices can be heard, Montgomery’s son who is 16 and Puerto Rican, and his 18 year old friend who is black, telling her to “go in the crib” multiple times.
"Go in the crib. Go in the crib. Yeah, that's where you go in the crib. Go in the crib."
Rice: "You don't even pay for the crib."
Montgomery son and friend:
"Go in the house. Go in the crib."
Rice:
"This is my estate."
The pair repeatedly told Rice to go to her home.
Rice then says “What do you do…section 8”
The back and forth continues until Rice can be seen marching up to the porch.
About 30 seconds after Rice steps on the porch, she is seen hitting one of the males, who Montgomery said was the friend.
She then lunged at Montgomery’s son, who was holding the phone. He shoves her to the ground.
Zikuski is then seen picking Rice off the ground before walking her off the property.
Montgomery’s son can be heard saying,
“You came on my property, you assaulted me first” and that he is a minor.
Kraham says Zikuski is on administrative leave pending a review.
“The female in the video is a private citizen — not employed by the City of Binghamton nor affiliated with the City in any official capacity. Still, I’m troubled by her language and the implication that she is in any way above the law because of a personal association with a member of law enforcement,” Kraham said.
After police failed to arrest Rice, Montgomery filed a formal report the following day in person. She says that she and Rice have never had an argument since she moved into the home in November.
