Your original theory was on the ball, and they have essentially already confirmed it on a previous reply to a motion to dismiss: Use the other (much weaker) torts as an excuse to keep the defamation from being dismissed hoping the judge will see the amount of legal paperwork filed by the plaintiff and say "well theres so much here" making an essay out of the reply falls into this potential legal theory.
I think this entire lawsuit aims at establishing a precedent for social media commentary and could massively impact what we are allowed to say on the internet.
If they manage to establish this "group of people who all do not like me talking about me in a public forum" as some kind of harassment, then free speech would be truly fucked.
That is why I think it will ultimately fail.
I truly think Alyssa would have a real case if she had gone about this in the proper fashion.
Just like another minor lolcow, Aaron Imholte, she failed to get a harassment restraining order against the people she claims are harassing her.
She keeps yapping about how terrible it is to be harassed, yet she has not taken even the most simplest of steps to avoid the harassment, or to make the harassment end.
In my opinion she should have done the following after sending out her C&D letters.
1. STFU about SmashJT
2. Compile all his videos and social media posts about her, report him for harassment under the FBI cyber harassment/bullying program
3. Using that FBI case number, file for a restraining order against SmashJT with the singular goal to "make him stop talk about me"
4. Set all her social media accounts to not accept DMs (as every normal person does, because that way you are not spammed by grifters and bots)
Had she done all those steps above and SmashJT had violated a restraining order, which she would very likely have been granted considering how low the evidentiary requirements for one are, she would now have a rather slam-dunk case.
Instead she has done none of the above and is trying to portray her neurotic behavior and medical issues (both physical and mental) as direct results of a single person "harassing her", while at the same time repeatedly explaining the "right wing harassment campaign" and attributing it to multiple people, none of which are party to the case.
I do think that a lot of the videos and commentary, mostly by SmashJT orbiters/leech creators who appeared on panels cross the line into harassment territory, but SmashJT is not responsible for their commentary, videos or opinions. She should settle the case with Jeff, agree on a "do not talk about each other" stipulation, and then go after the other smaller retards who posted harassing material after the lawsuit was already filed. Their videos and opinions are a lot more clear cut.
I particularly dislike that ToastywiththeMosty person, she is a prime lolcow who just repeats what other people said, without actually understanding anything about the topic or the nuances required to not walk into legal trouble out of sheer retardation. She also makes sexual thirst content, for which her channel was demonitized, and then misrepresented the action taken against her channel as part of a harassment campaign against herself and that it only happened due to mass reports.
